Checkrides.io provides a platform for aviation students, instructors, and pilots to:

• Access information about Designated Pilot Examiners (DPEs)
• Submit and view checkride experiences ("gouges")
• Prepare for FAA practical examinations
• Connect with the aviation community

DPE information is sourced from publicly available FAA records. User-submitted content represents individual experiences and opinions.

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

3.2 Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

4. User Content and Conduct

4.1 Content Submission

Users may submit checkride experiences, reviews, and other content ("User Content"). By submitting User Content, you grant Checkrides.io a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your User Content in connection with the Service.

4.2 Content Standards

You agree that your User Content will not:

• Contain false, misleading, or defamatory information
• Violate any third party's rights, including intellectual property rights
• Contain personal information of others without their consent
• Include discriminatory, harassing, or abusive language
• Violate any applicable laws or regulations
• Contain malicious code, viruses, or harmful content
• Impersonate any person or entity

While we strive to provide accurate DPE information sourced from FAA records, we cannot guarantee the accuracy, completeness, or timeliness of this information. Always verify DPE credentials with the FAA.

7.4 Service Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHECKRIDES.IO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service
• User Content or the defamatory, offensive, or illegal conduct of any third party

IN NO EVENT SHALL CHECKRIDES.IO'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO CHECKRIDES.IO IN THE LAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Checkrides.io, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any rights of another party

10. Payment Terms

Some features of the Service may require payment. By purchasing a subscription or paid service, you agree to pay all applicable fees. All fees are non-refundable unless otherwise stated. We use third-party payment processors (Stripe) to process payments, and your payment information is subject to their terms and privacy policies.

We reserve the right to change our fees at any time. We will provide you with reasonable notice of any fee changes by posting the new fees on the Service or by email.

11. Termination

11.1 By You

You may terminate your account at any time by contacting us or through your account settings.

11.2 By Us

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

11.3 Effect of Termination

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Checkrides.io regarding the use of the Service and supersede all prior agreements and understandings.
